Welcome to BEASTHAMMER! These Terms of Service (“Terms”) govern your use of our website, mobile app, and services (collectively, “Services”), including any purchases you make from us in the United Kingdom (UK), European Union (EU), United States (USA), Australia, or other regions we ship to. By visiting our site, creating an account, or buying our fitness gear, you agree to these Terms, along with our Privacy Policy at https://beasthammer.com/policies/privacy-policy and any linked policies. If you don’t agree, please don’t use our Services. We may update these Terms from time to time. Check this page for the latest version, as your continued use means you accept any changes.
Our store is powered by Shopify Inc. They provide the e-commerce platform we use to sell our products and process some of your data. Details are below.
1. Who We Are and How to Reach Us
1.1 About Us: We’re Beasthammer Ltd, a fitness clothing retailer registered in England and Wales with company number 08733634. Our registered office is at 10 Cherrywood Close, LS14 2HF Leeds, West Yorkshire, United Kingdom. We are registered with the Information Commissioner’s Office (ICO) under registration reference ZB763665.
1.2 Contact Us: Got questions? Email us at support@beasthammer.com or write to our office address. We aim to respond within 48 hours.
1.3 How We’ll Contact You: We’ll use the email you provide when you order or sign up. For urgent issues like delivery updates, we might also call or text the phone number you give us. Keep your details current so we can reach you.
2. Who Can Use Our Services
2.1 Age Rules: You must be 18 or older to place an order with us. If you’re between 13 and 17, you may browse our Site and create an account with your parent or guardian’s permission, but any purchase must be made by an adult. Our Services aren’t intended for anyone under 13.
3. Accounts and Security
3.1 Signing Up: To buy gear or access some features, you might need an account. You’re responsible for keeping your login details secure and for all activity under your account.
3.2 Staying Secure: Notice anything odd, like someone else using your account? Let us know immediately at support@beasthammer.com. We can disable any account that seems suspicious or violates these Terms.
3.3 Our Right to Act: We can terminate your account, refuse service, or cancel orders at our discretion, especially if we suspect fraud or breaches of these Terms.
4. SMS Marketing and Communications
4.1 Consent: By providing your mobile number during checkout, creating an account, or subscribing through any BEASTHAMMER communication form, you agree to receive automated promotional and personalised marketing text messages (such as special offers, updates, and order alerts) from BEASTHAMMER at the phone number provided. Consent is not a condition of purchase. Message frequency may vary, and standard message and data rates may apply.
4.2 Opting Out: You may opt out at any time by replying STOP to a message or contacting our support team directly. For help, reply HELP or email us using the contact information in clause 1.2.
4.3 Delivery of Messages: BEASTHAMMER will not be liable for any delays or failures in message delivery caused by network issues or mobile carriers. Your data will be managed in accordance with our Privacy Policy and applicable UK, EU, and U.S. data protection regulations.
5. Ordering Gear
5.1 How to Order: Add your picks to your basket on our website or app, then head to checkout. Enter your contact, delivery, and billing info, and triple check everything (size, address, etc.) before clicking “Pay Now.”
5.2 Order Acceptance: Your order is an offer to buy. We’ll email you to confirm we’ve received it, but the contract starts when we email again saying your gear’s shipped. You’ll get an order number. Keep it handy for any chats about your purchase.
5.3 If We Can’t Deliver: If we can’t fulfil your order due to stock issues, billing problems, or shipping restrictions, we’ll email you and won’t charge you.
5.4 Suspicious Orders: Our gear is for personal use only. If we spot bulk buys or suspect reselling, we may cancel your order. Think we’ve got it wrong? Reach out at support@beasthammer.com.
6. Pricing and Payment
6.1 Prices: Prices are in British Pounds (GBP) unless stated otherwise. For EU, USA, and Australia, prices are shown in GBP at checkout. Your bank may convert to your local currency, such as EUR, USD, or AUD, with possible fees. Check with them. We strive for accuracy — see clause 6.5 for errors.
6.2 How to Pay: We accept Visa, Mastercard, PayPal, and Apple Pay. We charge when your order ships, though you might see a pending transaction earlier. Payment options work globally, but local availability may vary, so check at checkout. We can adjust or remove payment methods, and we’ll notify you if it impacts your order.
6.3 Paying with Klarna: We offer Klarna as a payment option, letting you pay later or in instalments, subject to Klarna’s approval. If you choose Klarna, their terms apply alongside ours. Visit klarna.com for details. We may withdraw or suspend Klarna at our discretion, but we’ll let you know if it affects your order. Availability varies by region, so check at checkout.
6.4 Taxes and Duties: EU orders may face local VAT at import, USA orders might incur state sales tax, and Australian orders may include GST. These are your responsibility, not ours. If tax rates change before delivery, we’ll adjust unless you’ve paid in full.
6.5 Pricing Errors: If we catch a mistake before shipping, we’ll charge the lower amount if it’s less than listed. For obvious errors, like £5 leggings instead of £50, we can cancel, refund, and request the gear back.
6.6 Your Info: Provide accurate billing and account details, and update them as needed so we can process your order smoothly.
7. Discount Deals
7.1 Codes: We might send discount codes via email or promos. Enter one at checkout and hit “apply” to save. They have expiry dates and usually apply to full price items unless we specify otherwise. Codes work worldwide unless restricted to a region — check the offer details.
7.2 Rules: One code per order, no stacking with other deals, no cash value. Returns are refunded at the discounted price. Misuse, like faking codes, means we’ll cancel your order. We can tweak or end offers with notice.
8. Delivery
8.1 Where We Ship: We deliver to the UK, EU, USA, Australia, and other regions. See our shipping policy at https://beasthammer.com/policies/shipping-policy for exclusions. You’re responsible for customs duties, taxes, or import fees, such as EU VAT at import, US duties over $800, or Australian GST. If you don’t pay within 7 days of notice, your order returns to us, and we’ll deduct return and original shipping costs from your refund.
8.2 How Your Order Is Fulfilled: Some BEASTHAMMER items are held in our own stock and dispatched by us directly. Others are produced to order by our fulfilment partner and shipped from their facility, which means they require production time before dispatch and take longer to arrive. The estimate applicable to each item is shown on its product page.
8.3 Costs and Timing: Delivery fees and estimated timescales vary depending on the item, the fulfilment method, and the destination. Full details are set out in our shipping policy at https://beasthammer.com/policies/shipping-policy. All estimates are given in business days and are estimates only, not guarantees. Customs clearance, public holidays, peak trading periods, and courier delays may extend them.
8.4 Split Deliveries: Orders containing both own-stock and made-to-order items will be dispatched separately and will arrive at different times. You’ll receive separate tracking for each shipment, and there is no additional charge to you for a split delivery.
8.5 Unavoidable Delays: Weather, courier glitches, or customs hold-ups might slow your order. We’ll notify you quickly, and if it’s a major delay, you can cancel for a refund on undelivered items.
8.6 No One Home: If you’re not around and it won’t fit your letterbox, the courier will leave reschedule or pickup instructions. Collect from a pickup point within 14 days, or we’re not liable if it goes missing. If you ask for a “safe place” drop-off, it’s your risk after that.
8.7 Damaged Goods: Parcel arrives battered? Snap a photo or video before opening, and keep recording as you unpack. Without evidence we may not be able to assist, so don’t skip this. Contact us at support@beasthammer.com as soon as possible if it’s damaged or incorrect.
8.8 Courier Terms: By ordering, you agree to our couriers’ standard terms. See their websites for details.
9. Products and Warranty
9.1 Our Gear: We sell fitness clothing and accessories to fuel your workouts.
9.2 Descriptions: We aim for accurate product details and images, but screen displays vary. Colours might not be exact, and errors can happen.
9.3 Warranty: Our gear comes with a 90-day warranty from delivery for manufacturing defects. Exclusions include normal wear, accidents, or modifications. Contact us at support@beasthammer.com with proof of purchase and defect photos to claim. UK customers have statutory rights under the Consumer Rights Act 2015. EU customers get a 2-year legal guarantee under EU law. Australia has the Australian Consumer Law (ACL), ensuring remedies for a reasonable time if defective. Whichever protection is longer applies where required.
10. Returns and Refunds
10.1 Change Your Mind: Not feeling it? Return within 30 days of delivery for a refund. That’s more generous than the UK and EU’s 14-day legal minimum. Items must be unworn, tags on, in original packaging. You may pay return shipping. See our refund policy at https://beasthammer.com/policies/refund-policy.
10.2 Made-to-Order Items: Items produced to order by our fulfilment partner carry the same 30-day return right as items from our own stock. Only goods personalised to your own specification are excluded.
10.3 Faulty Goods: If it’s defective or materially different from our description, return within 30 days for a full refund, shipping included. EU customers have a 2-year guarantee. Australia’s ACL remedies (repair, replace, refund) may extend beyond 30 days if faulty. Your local rights apply too.
10.4 Non-Returnable Items: No returns for underwear, swimwear, or items personalised to your specification, unless defective, or for anything used, damaged, or missing parts.
10.5 Sale Items: Bought on sale? Swap or get store credit within 30 days. Refunds only if defective. This doesn’t affect your legal rights.
10.6 Refund Process: Refunds go back to your original payment method within 14 days of us receiving the item. Part-paid with a gift card? That’s credited first. Used a discount? We refund what you actually paid.
10.7 Promotional Freebies: Get a freebie, like a tee for orders over £50? If returns drop you below the threshold, we’ll deduct its value from your refund. Freebies can’t be returned alone — no swaps or cash.
10.8 Multi-Buy Offers: In a ‘Buy 2, Get 1 Half Price’ deal? Returning one item refunds the lowest-priced item’s cost.
10.9 How to Return: Email support@beasthammer.com with your order number, and we’ll send instructions and the correct return address. Full details are in our refund policy.
10.10 Your Rights Stay Safe: These terms don’t override your local legal rights, such as the UK Consumer Rights Act 2015, EU consumer directives, the Australian ACL, or US state laws.
11. Gift Cards
11.1 Gift Cards: Buy one online (digital code) or in-store (physical card). They’re valid for 12 months from purchase and work only on our UK site or stores unless we expand. Check at checkout.
11.2 Rules: No cash exchanges, no using one to buy another, no change if you spend less — use the rest later. Lost or stolen? We can’t replace them or cover unauthorised use. Check your balance at support@beasthammer.com.
12. Your Data
12.1 Our Use: We collect data, like name and address, to process orders, manage accounts, and improve your shopping experience. Full details are in our Privacy Policy at https://beasthammer.com/policies/privacy-policy.
12.2 Shopify’s Role: Shopify processes payment and browsing data for us, following GDPR and their own policies. See their Privacy Policy for more.
12.3 Regional Privacy: We handle your data according to local laws. EEA and UK: we comply with GDPR and UK GDPR — your rights (access, deletion, and so on) are covered, and we’re registered with the ICO under reference ZB763665. USA: we meet California CCPA standards — email us at support@beasthammer.com to opt out or request your data. Australia: we follow the Privacy Act 1988, ensuring consent and protection — contact us for access or corrections. Everywhere else: we respect your local privacy laws too.
12.4 Advertising and Tracking: We use Meta (Facebook and Instagram) advertising tools, including Meta Pixel, and Google Analytics and Google Ads, to show relevant ads and measure performance. These tools may collect or receive data such as actions taken on our site, approximate location, and device information. Meta’s privacy policy is at https://www.facebook.com/about/privacy and Google’s at https://policies.google.com/privacy. 13. Liability and Governing Law
13.1 Our Liability: We don’t exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any breach of your statutory rights as a consumer.
13.2 Foreseeable Loss: Where we are liable, we’re responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care. We’re not responsible for loss or damage that isn’t foreseeable.
13.3 Business Losses: If you use our Services for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
13.4 Events Beyond Our Control: We’re not liable for delays or failures caused by events outside our reasonable control, including natural disasters, pandemics, strikes, carrier failures, customs action, or political and economic disruption. If such an event occurs, we’ll contact you as soon as possible and you may cancel any undelivered items for a refund.
13.5 Governing Law: These Terms are governed by the law of England and Wales. If you’re a consumer resident in the EU, Australia, or elsewhere, you also benefit from any mandatory protections of your own country’s law, and nothing here removes your right to bring proceedings in your local courts.
13.6 Severability: If any part of these Terms is found to be unenforceable, the rest remains in full effect.
14. VIP Program
14.1 Overview
The BEASTHAMMER VIP Program provides select customers with lifetime free standard shipping, together with access to promotions, events, and limited releases from time to time. The scope and availability of benefits may change at our discretion.
14.2 Eligibility
Eligibility for VIP status is determined solely by Beasthammer Ltd. We may set purchase thresholds, time limits, or other criteria. We may revoke or change eligibility requirements at any time.
14.3 Lifetime Free Shipping
VIP members receive lifetime free standard shipping on all orders. This applies only to orders placed through official BEASTHAMMER online stores. It does not apply to international surcharges, customs fees, or expedited delivery options.
14.4 Exclusive Offers and Early Access
VIP members may receive early access to new drops, special pricing, and limited edition items. Access is not guaranteed for every release and may vary by region or stock availability.
14.5 Communications
By joining the VIP Program, you agree to receive relevant email or SMS updates about VIP benefits. Opting out of communications may limit your ability to receive certain offers. See section 4 for our full communications and opt-out terms.
14.6 Gym Access — Withdrawn
Earlier versions of the VIP Program included a benefit offering free lifetime access to any gym that BEASTHAMMER might own and operate in the future. That benefit was withdrawn on 1 September 2026 and is no longer part of the VIP Program. VIP membership acquired on or after that date does not include gym access of any kind.
Members who qualified for gym access on or before 31 August 2026 keep that benefit. It remains honoured on the terms under which they qualified, as set out in the version of these Terms dated 1 November 2025. A copy of that version is retained by us and available to any affected member on request by emailing support@beasthammer.com. Nothing in these current Terms reduces or removes that benefit.
14.7 Non-Transferability
VIP status and all associated benefits are personal to the qualifying customer. They cannot be transferred, gifted, sold, inherited, or assigned. Any attempt to transfer VIP benefits voids the VIP status.
14.8 Misuse of VIP Benefits
We may suspend or permanently revoke VIP status if a member misuses the program, acts fraudulently, creates multiple accounts to gain additional advantages, or behaves in a way that harms the intended purpose of the program. No refunds or compensation will be provided if VIP status is revoked.
14.9 Program Termination
BEASTHAMMER reserves the right to modify or terminate the VIP Program at any time. Termination or changes to the program do not create any obligation to provide compensation or alternative benefits for future VIP perks. This does not affect benefits already accrued to existing members under clause 14.6.
14.10 Force Majeure
VIP benefits may be delayed, limited, or unavailable due to circumstances beyond our control, including natural disasters, pandemics, strikes, political or economic events, or other unforeseeable situations. We are not liable for any losses or inconvenience caused by such events.
14.11 Legal Compliance
VIP membership and benefits are subject to applicable local laws, regulations, and age restrictions. Members must comply with all local legal requirements to enjoy VIP benefits.
15. Using Our Site
15.1 Play Nice: Use our site lawfully. Don’t interfere with others’ rights or enjoyment.
15.2 What’s Off-Limits: No copying our content for profit, no hacking, no spam, no posting hate or viruses. Violate these, and we’ll cut you off.
15.3 Our Intellectual Property: The BEASTHAMMER name and logo are our registered trade marks. All content on this Site, including text, images, and designs, belongs to Beasthammer Ltd or our licensors and may not be reproduced for commercial purposes without our written permission.
